The rules for using GroomCard, the client records and online booking app for dog grooming salons.
1. About these terms
These Terms of Service (the Terms) are the agreement between you and the operator of GroomCard. Read them before you create an account.
GroomCard is operated by Matej Havlik, a sole trader registered in the Czech Republic, business ID (ICO) 14371758, Heroutova 831, Ceska Lipa, Czech Republic. The operator is not registered for VAT. Below, we and us mean the operator.
GroomCard is the web app at groomcard.com (the service). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service. Questions about anything here go to support@groomcard.com.
2. What GroomCard is
GroomCard is software for dog grooming salons. It keeps client and dog records, a calendar of appointments, visit history, receipts and exports, and it gives your salon an online booking page your clients can book through.
Notifications and reminders are sent by email only. GroomCard does not send text messages, and we do not promise that it ever will.
GroomCard is business software, not a veterinary or medical record system. Nothing in the app is veterinary advice. You decide how to groom a dog.
We improve the service over time, which means features can be added, changed or retired. The current feature set is what you see on the site and in the app.
3. Your account and eligibility
You need an account to use GroomCard. To open one you must be at least 18 years old and able to enter into a binding contract. GroomCard is intended for business use, not for personal or household use.
Give accurate account details and keep them up to date, especially your email address. We use it for receipts, service notices and password resets.
You are responsible for keeping your login safe and for everything that happens under your account, including anything done by groomers you give access to. If you think someone else has your password, change it and email support@groomcard.com.
One salon means one account. Do not share a single login with people outside your salon.
4. Acceptable use
Use GroomCard lawfully and reasonably. Do not use it to send unsolicited or unlawful messages, to store content you have no right to store, or to harass anyone.
Do not try to access another salon's data, probe or bypass our security, scrape the service, reverse engineer it, or put load on it that a normal salon would not. Do not upload malware.
Do not resell, sublicense or white-label GroomCard without our written permission.
If an account puts the service, our providers or other customers at risk, we may limit or suspend it. Where it is reasonable to do so, we tell you first and give you a chance to fix the problem.
5. Plans and pricing
The free plan includes every feature, capped at 10 clients and 10 online bookings per calendar month. Appointments you enter yourself do not count toward the online booking cap. When you hit a cap, your existing records stay exactly where they are, but you need Pro to keep adding beyond it.
Pro costs $22 per month, or $190 per year when you pay yearly, which saves about 28% against paying monthly. All prices are in US dollars. The operator is not registered for VAT, so no VAT is added to the price.
If a free trial is offered when you activate Pro, its length is shown to you before you confirm, and the first charge happens at the end of the trial unless you cancel before it ends.
We may change prices. If a change affects your subscription, we tell you by email or in the app before it takes effect, and it never applies to a period you have already paid for.
6. Billing, renewal and cancellation
Payments are processed by Stripe. We never see or store your full card number. Stripe handles the card details under its own terms and privacy policy.
A Pro subscription renews automatically at the end of each billing period, monthly or yearly, at the price for your plan at that time, until you cancel it.
You can cancel at any time in the billing section of your account. Canceling stops the next renewal. You keep Pro until the end of the period you have already paid for, and after that the account drops back to the free plan.
We do not refund partial periods. If you cancel in the middle of a month or a year, the time you have already paid for is not refunded, unless the law requires a refund or we decide to make an exception.
If a payment fails, Stripe may retry it. If it keeps failing, we may pause Pro features until the payment goes through.
7. Your data
Your client records, dog records, photos, notes, appointments and receipts are yours. We claim no ownership of them.
You grant us the permission we need to store, process, back up and display that content for the sole purpose of running the service for you and supporting you when you ask.
You are responsible for what you put into GroomCard, including having a lawful basis to keep personal information about your clients. In legal terms, you are the controller of that information and we are your processor. The Privacy Policy explains how that works.
You can export your data from the app at any time. Do it before you close your account. After closure we delete or anonymize your data within a reasonable period, apart from records we must keep by law.
We may use aggregated statistics that cannot identify you or your clients to understand how the service is used and to improve it.
8. Availability and support
We work hard to keep GroomCard available and fast, but we do not guarantee uninterrupted service. It can go down for maintenance, because of an outage at one of our infrastructure providers, or because of something outside our control.
Support is by email at support@groomcard.com. We answer as quickly as we reasonably can. There is no guaranteed response time and no service level agreement.
Keep your own copy of anything you cannot afford to lose. Regular exports are the simplest way to do it.
9. Disclaimer of warranties
The service is provided as is and as available, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement.
We do not warrant that the service will be uninterrupted, secure or error free, that defects will be corrected, or that it will meet your particular requirements.
Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for lost profits, lost revenue, lost bookings, lost goodwill, or lost or corrupted data, or for any indirect, incidental, special, punitive or consequential damages arising out of your use of the service.
Our total liability for all claims relating to the service in any 12-month period is limited to the amount you actually paid us for GroomCard in the 12 months before the event that gave rise to the claim. On the free plan that amount is zero.
Nothing in these Terms limits liability that cannot be limited by law, including liability for intentional misconduct, gross negligence, or death or personal injury caused by negligence.
11. Termination
You can stop using GroomCard whenever you like. Cancel the subscription in the billing section and delete the account from your settings.
We may suspend or close an account that breaks these Terms, that has not paid, or that puts the service at risk. Where it is reasonable, we warn you first. If we close your account without cause, we refund the unused part of a period you have paid for.
When an account closes, access ends and the data is deleted or anonymized within a reasonable period, except for anything we are legally required to keep, such as accounting records. Export your data first.
12. Changes to these Terms
We may update these Terms as the service grows and as the law changes. If a change is material, we tell you by email or in the app before it takes effect.
Using the service after a change takes effect means you accept the updated Terms. If you do not accept them, cancel your subscription and close your account. The date at the top of this page shows when the Terms were last updated.
13. Governing law and disputes
The operator is based in the Czech Republic, so these Terms and any dispute arising from them are governed by the law of the Czech Republic, without regard to its conflict of law rules, and the Czech courts have jurisdiction. We say this plainly rather than pretending the service is operated from the United States.
If you use GroomCard as a consumer rather than as a business, mandatory consumer protections of the country you live in still apply, and nothing here takes them away.
Before anyone goes to court, email support@groomcard.com. Almost everything gets sorted out that way.
14. Everything else
If any part of these Terms turns out to be unenforceable, the rest stays in force.
You may not transfer your rights under these Terms without our written consent. We may transfer ours to a successor of the business, and we will tell you if that happens.
Not enforcing a right straight away does not mean we give it up.
These Terms and the Privacy Policy together are the whole agreement between you and us about the service.
